1. What MonacoTop is — and is not

MonacoTop is an online directory and listings platform. We publish property, yacht, motorcar, aircraft and berth listings and a directory of professional firms, and we provide tools to discover them and to request an introduction.

MonacoTop acts solely as an intermediary that connects users with independent third-party companies. We are NOT an estate agent, yacht or aircraft broker, motor dealer, auctioneer, lender, financial intermediary, tax or legal adviser, or a fiduciary. We do not own, sell, let, charter or value any asset listed on the site.

No mandate, agency, partnership, joint venture or employment relationship is created between you and MonacoTop by your use of the site.

2. We are not a party to any transaction

Any enquiry, negotiation, viewing, agreement, sale, purchase, lease, charter or other transaction is concluded solely and directly between you and the relevant listed company or professional. MonacoTop is not a party to it, does not participate in it, holds no client monies, and gives no guarantee that any transaction will be entered into or completed.

You are responsible for carrying out your own due diligence and for obtaining independent legal, tax, financial and technical advice before entering into any transaction.

3. Third-party content

Listings, descriptions, specifications, prices, availability, images and company profiles are supplied by third parties or compiled from public sources. MonacoTop does not verify, endorse or guarantee their accuracy, completeness, legality or currency.

All prices are indicative, may exclude taxes, duties, fees and commissions, may be shown "on request", and are subject to change or withdrawal without notice. Nothing on the site is an offer capable of acceptance.

4. No endorsement; no advice

The presence, ranking, rating or "verified" status of any company in our directory does not constitute an endorsement, recommendation, certification or guarantee by MonacoTop of that company or of its services.

All content is general information only. It does not constitute legal, tax, financial, investment or other professional advice, and must not be relied upon as such.

5. Acceptable use

• Use the site lawfully and only for genuine, personal, non-commercial enquiries.
• Do not scrape, harvest, copy or re-publish listings, the directory or any data.
• Do not submit false, misleading or unlawful information, or impersonate any person.
• Do not attempt to interfere with, probe or circumvent the security of the site.

6. Site provided “as is”

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by Monegasque law, MonacoTop excludes all warranties, express or implied, including as to accuracy, availability, fitness for a particular purpose and non-infringement.

7. Limitation of liability

To the fullest extent permitted by the law of the Principality of Monaco, MonacoTop shall not be liable for any loss or damage — direct or indirect, foreseeable or not, including loss of profit, opportunity, data or goodwill — arising out of or in connection with: (a) your use of, or inability to use, the site; (b) any reliance on content; or (c) any dealing, transaction or dispute between you and a listed company.

Where liability cannot lawfully be excluded, our total aggregate liability is limited to the amount (if any) you paid to us for the use of the site in the twelve months preceding the event, or €100, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Monegasque law (including for fraud or gross negligence).

8. Indemnity

You agree to indemnify and hold harmless MonacoTop, its officers and staff against any claim, liability, loss or cost (including reasonable legal fees) arising from your use of the site, your breach of these Terms, or any transaction or dispute between you and a listed company.

9. External links

The site contains links to third-party websites operated by listed companies and others. MonacoTop has no control over and accepts no responsibility for their content, products, services or privacy practices.

10. Changes

We may amend these Terms at any time by posting the updated version on the site. Continued use after changes constitutes acceptance.

11. Severability & force majeure

If any provision is held unenforceable, the remainder continues in force. MonacoTop is not liable for any failure or delay caused by events beyond its reasonable control.

12. Governing law & jurisdiction

These Terms are governed by the law of the Principality of Monaco. Any dispute is subject to the exclusive jurisdiction of the courts of the Principality of Monaco.
